Mr. Jai Narain Thakur, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 28-07-2022 Heard the learned counsel for the petitioners and learned APP for the State.

Learned APP for the State submits that the process of Sections 82 and 83 of the Cr.P.C. was issued against these petitioners, namely, Punam Kumar and Malati Devi on 11.08.2021 while anticipatory bail has been filed in this Court on 03.02.2022, hence, in view of the observation of the Apex Court, this bail petition is not maintainable because before filing of the bail petition already processes have been issued under Sections 82 and 83 of the Cr.P.C. against these petitioners and this fact also corroborates from perusal of the case diary. Accordingly, this petition is disposed of.

Patna High Court CR. MISC. No.5114 of 2022(3) dt.28-07-2022 2/2 However, the petitioners are directed to surrender before the court below and pray for regular bail and the court below may consider their regular bail without being prejudiced of this order.
