JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-01-2015 The petitioner is languishing in custody since 25.03.2014 in a case registered for the offences punishable under Sections 366A, 379 of the I.P.C.

The accusation is of kidnapping the married daughter of the informant. Though the victim has been recovered from the house of the petitioner.

It is submitted by learned counsel for the petitioner that in 164 Cr.P.C statement though the victim has named this petitioner also but thrust of accusation is against Sugreev Yadav who established physical relationship also. The statement of the mother of the victim has been recorded during investigation who also admitted love affairs of her daughter with Sugreev Yadav and Sugreev Yadav has been granted bail vide Cr. Misc. No. 29827 of 2013 which has been brought on record as Annexure-3/1.

Patna High Court Cr.Misc. No.23810 of 2014 (3) dt.05-01-2015 2/2 A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Dumran P.S. Case No. 270 of 2011.

Learned Court below will cancel the bail bonds of the petitioner, if the petitioner defaults for three consecutive occasions during the trial.
