This is an application for grant of regular bail filed on behalf of the petitioner. Petitioner is in custody in connection with Patliputra PS Case No. 499 of 2018 for the alleged offence under Section 379/411 of the Indian Penal Code. As per the FIR, allegation against the petitioner is that the petitioner tried to take away the motor cycle of the informant bearing Registration No.BR31R 9738 which was kept outside a car show room. When the informant found his motor cycle missing, he checked through GPS system installed in his motor cycle and found the location of his stolen motor cycle near Patna Women's College and when he rushed there,

Patna High Court Cr.Misc. No.2295 of 2019(2) dt.17-01-2019 2/2 petitioner was found allegedly taking away his motor cycle and he was apprehended.

Learned counsel representing the petitioner submits that the petitioner has been falsely implicated in the instant case. He submits that petitioner has no criminal antecedent and he is in custody since 26.10.2018.

Considering the aforesaid fact situation, this application is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Judge XII-cum-ACJM, Patna in connection with Patliputra PS Case No. 499 of 2018 subject to the condition that (a) one of the bailors should be the landlord and (b) in the event the name of the petitioner further figures in similar such case, the court below shall be at liberty to cancel the bail bond of the petitioner.
