The petitioners being the elder brothers of the husband of the victim are languishing in custody since 09.02.2015 and 23.02.2015 in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code. The accusation is of killing the daughter of the informant after three years of the marriage for non-fulfillment of the dowry demand.

It is submitted by learned counsel for the petitioners that accusation is not specific against the petitioners and after the death of the victim the husband of the victim

Patna High Court Cr.Misc. No.22702 of 2015 (2) dt.10-07-2015 2/2 committed suicide. Subsequently the informant has retracted from the initial version and filed a petition to that effect before the learned court below. The same has been brought on record as Annexure-2.

Considering the aforesaid facts, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Daudnagar, Aurangabad in connection with Bandhya P.S. Case No. 01 of 2015.
