Petitioner is accused in connection with Katihar (S) P.S. Case No. 766 of 2015 registered under Section 376 of the I.P.C.

The prosecution case is that petitioner entered in the house of the informant and committed rape. It is also alleged that before two months the petitioner developed physical relation on the pretext to perform the marriage with her but when the Panchayati was arranged, petitioner and his family members refused to marry with her.

No.13686 of 2016 (2) dt.19-04-2016 2/2 Learned counsel appearing on behalf of the petitioner submits that in fact, parents of the informant wanted to perform marriage with this petitioner but other family members of the informant is not ready to perform the marriage with him. Due to that reason, petitioner has been made accused in this case. It is also submitted that petitioner has no criminal antecedent and is in custody since 17.01.2016.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Katihar in connection with Katihar (s) P.S. Case No.766 of 2015. Out of two sureties, one surety must be parents or close relatives of the petitioner.
