2. The petitioner is in custody in connection with Parbatta P.S Case No. 424 of 2024 registered for the offences punishable under Sections 126(2), 115(2), 109(1), 352, 351(2), 303(2), 3(5) of B.N.S.

3. As per prosecution case, petitioner along with co-accused assaulted the informant and his nephew by lathi.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that instant case is due to land dispute between the parties. It is also submitted that petitioner is in

Patna High Court CR. MISC. No.7016 of 2025(3) dt.19-04-2025 2/2 judicial custody since 27.11.2024.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

6. On perusal of the FIR and impugned order, it appears that allegation against the petitioner is general and omnibus in nature. From Post mortem report, it appears that only injury no. 2 is grievous in nature.

7. So, considering the weapon used in the incident and nature of injuries, along with aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M-1st Class, Khagaria in connection with Parbatta P.S Case No. 424 of 2024.
