Dr. Indiwar Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-01-2020 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek regular bail in connection with Keoti P.S. Case No. 23 of 2019 for the offence registered under Sections 341, 323, 324, 307, 504, 506/34 of the Indian Penal Code.

The allegation is regarding the accused persons including the petitioners herein having assaulted the informant resulting in the informant being inflicted with multiple injury on the head.

The learned counsel for the petitioners has submitted that the petitioner is innocent and has been falsely implicated in the present case. It is further submitted that the petitioners are

Lastly, it is submitted that a general and omnibus allegation has been levelled against the accused persons and as far as the petitioners are concerned, there is no allegation of any specific overt act.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioners coupled with the fact that the allegations levelled against the accused persons including the petitioners herein are general and omnibus in nature and no specific overt act has been alleged to have been committed by the petitioners, I deem it fit and proper to direct for release of the petitioners herein on regular bail.

Accordingly, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VII, Darbhanga in connection with Keoti P.S. Case No. 23 of 2019.
