JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-04-2021 The present writ petition has been filed for quashing that part of the order dated 23.09.2020 by which the petitioner has been directed to deposit a sum of Rs. 10,32,600/- as additional performance security, since the same has been wrongly calculated and further for quashing the order dated 26.12.2020 by which the petitioner has again been directed to take steps to get the agreement executed in respect of the work namely Khakhara Jeeva Bigha Road NABARD to Shiva Bigha under the head MMGSY, after depositing the aforesaid amount of additional performance security.

Patna High Court CWJC No.4973 of 2021(2) dt.17-04-2021 2/2 At the outset, the learned counsel for the petitioner seeks liberty to agitate his grievances before the Bihar Public Works Contracts Disputes Arbitration Tribunal, in accordance with clause 33 of the NIT in question, however, seeks some protection, in the meantime, in order to enable the petitioner to approach the said Tribunal.

The learned counsel for the State has got no objection. Accordingly, the present writ petition stands disposed off with liberty to the petitioner to approach the Bihar Public Works Contract Disputes Arbitration Tribunal for redressal of his grievances, however in order to enable the petitioner to approach the said Tribunal and obtain interim orders, if any, this Court deems it fit and proper to direct the parties to maintain status quo, existing as on today qua the petitioner herein for a period of eight weeks from today.
