JUSTICE SUDHIR SINGH ORAL ORDER 12-08-2015 The petitioner is languishing in custody since 18.03.2015 in connection with Basantpur P.S. Case No. 230 of 2014 for the offences instituted under Sections 147, 148, 149, 323, 324, 325, 326, 307 and 302 of the I.P.C.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that on 21.07.2014 the informant was in the field of Madhopur Village then all the F.I.R. named accused persons came with Axe, Spade, Farsa and started assaulting his uncle Yamuna Bhagat, Dhanesh Bhagat and Sonalal Bhagat due to earlier land dispute. It is further alleged that his uncle was seriously injured due to Kanhaiya Bhagat's assault. In the injured condition, the victims were taken to P.M.C.H. where

Patna High Court Cr.Misc. No.23555 of 2015 (3) dt.12-08-2015 2/2 his uncle Yamuna Bhagat died. It is further alleged that due to earlier land dispute this occurrence has taken place. It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.03.2015 and the charge sheet has been submitted in the present case. It is further submitted that the petitioner has got no criminal antecedent. It is further submitted that the general and omnibus allegation has been made against the petitioner. The alleged occurrence is said to have taken place due to land dispute. It is case and counter case. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Siwan, in connection with Basantpur P.S.
