JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-01-2019 Petitioner apprehends her arrest in connection with Raxaul P.S. Case No. 51 of 2018 registered for the offences punishable under Sections 366A and 34 of the Indian Penal Code.

Allegation against son of the petitioner and others is of kidnapping of daughter of informant and when they went to complain about the same to the petitioner she has not cooperated the informant. Submission of learned counsel for the petitioner is that the main allegation is against son of the petitioner and she has been made accused only because she is mother. Heard learned APP also.

Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest

Patna High Court Cr.Misc. No.1634 of 2019(2) dt.24-01-2019 2/2 or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Raxaul, East Champaran at Motihari, in connection with Raxaul P.S. Case No. 51 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
