JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the F.I.R. and it is stated that he was caught by C.C.T.V. while he along with others was committing theft of motor cycle.
The contention on behalf of the petitioner is that petitioner does not have any criminal antecedent and as a matter of fact, he had gone to the place of occurrence in connection with his personal work but unfortunately, he has been made accused in this case on the basis of C.C.T.V footage.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named,
Patna High Court Cr.Misc. No.22496 of 2015 (2) dt.03-07-2015 2/2 be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Kotwali P.S.Case No. 16 of 2015.
