JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was Ward Commissioner at the relevant time and, allegedly, he produced sanctioned orders of 111 of applications for grant of Samajik Suraksha Pension but, subsequently, it was detected that the documents relating to sanctioned order were forged and fabricated.

Contention on behalf of the petitioner is that petitioner being Ward Commissioner collected the applications of people of his locality and handed over the said applications to Assistant of the concerned Department and according to the prosecution case itself, the aforesaid sanctioned order were produced by Assistant

Patna High Court Cr.Misc. No.14183 of 2016 (2) dt.05-04-2016 2/2 of the concerned Department before the informant. It is submitted that petitioner has been named in this case on account of political rivalry.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bagaha (West Champaran) in connectin with Bagaha P.S.Case No. 66 of 2016.
