JUSTICE BIRENDRA KUMAR ORAL ORDER 28-01-2019 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 366A, 120B and 504 of the Indian Penal Code.
Petitioner No. 3 Chhote Lal Paswan and petitioner no. 4 Saraswati Devi have already been arrested in this case. Hence, their prayer for anticipatory bail has become infructuous. Since, the victim-girl in her statement under Section 164 Cr.P.C. stated that she had voluntarily married with Motak Paswan, hence, let the petitioner no. 1 Gidik Paswan,
Patna High Court Cr.Misc. No.4448 of 2019(2) dt.28-01-2019 2/2 petitioner no. 2 Rajesh Paswan, petitioner no. 5 Rita Devi and petitioner no. 6 Sita Devi, who are relations of Motak Paswan, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.20,000/- (rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Brahmpur Police Station Case No. 431 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner no. 1, 2, 5 and 6 shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner no. 1, 2, 5 and 6.
