JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-01-2019 This is an application for grant of anticipatory bail in connection with Chiraiya P.S. Case No. 316 of 2018, disclosing offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Allegation as per F.I.R. is that police on information that the petitioner along with one other co-accused Santosh Kumar has kept huge quantity of Nepali liquor for sell, on that information police raided the house of one Dharmendra Kumar and recovered 397 liters Nepali liquor from his house. Submission of learned counsel for the petitioner is nothing has been recovered from the possession of the petitioner and the recovery is from the house of one Dharmendra Kumar. Further, the petitioner has no criminal antecedent.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 7th Additional Sessions Judge Cum Special Judge Excise, Motihari, East Champaran, in connection with Chiraiya P.S. Case No. 316 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
