2. The petitioner apprehends arrest in connection with Barachatti P.S. Case No. 288 of 2024 registered for offences under Sections 8, 20(b)(ii)(c) of the NDPS Act.
3. As per the prosecution case, the petitioner is the owner of the truck in question from which 1 Kg Doda has been recovered.
4. Learned counsel for the petitioner submits that the petitioner is quite innocent and has not committed any offence. He further submits that the truck was being driven by the driver, and the petitioner was unaware that doda was being carried therein. He also submits that the petitioner resides in Punjab, whereas the Doda was recovered in the District of Gaya, Bihar.

5. Learned APP for the State has vehemently opposed the prayer for bail.
6. Considering the above facts and circumstances of the case, this application for anticipatory bail stands allowed.
7. Accordingly, let the petitioner, above-named, in the event of arrest or surrender within four weeks from today in the Court below, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned concerned Court below, Gaya in connection with Barachatti P.S. Case No. 288 of 2024 subject to the conditions as laid down under Section 482(2) of the BNSS and with further conditions that:- (i). The petitioner will mark his attendance at the Badali Ala Singh, Police Station District Fatehgarh Sahib, Punjab on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
(ii). The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and non-cooperation in the trial shall result in cancellation of the bail bond of the petitioner.
(iii) At the time of accepting the bail bonds of the petitioner, the Court below shall verify the fact whether the petitioner
Patna High Court CR. MISC. No.6991 of 2025(4) dt.20-02-2026 3/3 has clean antecedent or not. If it is found that the petitioner has clean antecedent then only his bail bonds shall be accepted by the Court below.
(iv). However, it is made clear that the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
8. Let a copy of this order be communicated to the Senior Superintendent of Police, Fatehgarh Sahib, Punjab through FAX for its compliance forthwith.
