JUSTICE AMARESH KUMAR LAL ORAL ORDER 02-06-2015 Both these applications arise out of Rosera P.S.Case No. 343 of 2014 registered for the offence under section 399, 402 and 25 ( 1-b) a, 26, 35 of the Arms Act of the Indian Penal Code and as such, they have been heard together and are being disposed of by this common order.

No.15179 of 2015 (2) dt.02-06-2015 2/3 The allegation is that on secret information that some criminals have assembled with intention to commit crime at Lichi Orchard near Station, the police raided that place and apprehended three persons including the petitioners and two others managed to escape. On their search, one country made pistol and one cartridge were recovered from the possession of one Sanjit Kumar, and one motorcycle was recovered from Lichi Orchard. Learned counsel for the petitioners submits that nothing has been recovered from the possession of the petitioners and the petitioners have been apprehended by the police only on suspicion. Petitioners have no criminal antecedent and they are in custody since 7.11.2014.
Considering the facts and circumstances of this case, the above-named petitioners are directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate in Rosera P.S. Case No.343 of 2014 with the following conditions :
1.
One of the bailors will be the close relative of the petitioners.
2.
The petitioners will not indulge in similar or in any other offence.

The petitioners will be well represented in the court.

In case of absence for two consecutive dates or in violation of the terms of the bail, their bail bond will be liable to be cancelled by the court concerned.
