The petitioner seeks pre-arrest bail in connection with Tajpur (Halai) P.S. Case No.396 of 2018 for the offence punishable under Sections 30(a) and 37(a) of the Bihar Prohibition and Excise Act.

Considering the allegation made in the first information report that the petitioner is involved in illegal trade of wine and recovery of one cartoon of illicit liquor from turmeric field as also the provisions prescribed under subsection (2) of section 76 of the Bihar Prohibition and Excise Act, 2016, I am not inclined to grant him pre-arrest bail. The application is rejected.

In case, the petitioner surrenders and seeks bail, the same shall be considered on its own merit without being
