JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-03-2022 Heard the learned counsel for the petitioner and the learned APP for the State as also the learned counsel appearing for the informant. The present petition is by way of second attempt at the behest of the petitioner for grant of bail in connection with Ara Nagar P. S. Case No. 31 of 2020 under Sections 341, 323, 307, 34 of the Indian Penal Code and later on, Section 302 of the Indian Penal Code was added and Section 27 of the Arms Act inasmuch as his earlier prayer for grant of bail was rejected by this Court vide order dated 18.1.2021 passed in Criminal Miscellaneous No. 28762 of 2020.

Patna High Court CR. MISC. No.5175 of 2022(2) dt.09-03-2022 2/2 The allegation is regarding the petitioner having fired gunshot on the neck of the deceased, namely, Bunti Kumar, resulting in his death.

The learned counsel for the petitioner has submitted that though the petitioner is languishing in custody since 22.1.2020, the trial is not nearing completion, hence, the petitioner be granted the privilege of bail.

Having heard the learned counsel for the parties and having perused the materials on record, this Court finds that there is no change in circumstance so as to warrant reconsideration of the prayer of the petitioner for grant of bail, apart from the fact that the petitioner is alleged to have engaged in a heinous crime of murder, hence, I do not find any merit in the present petition.

Accordingly, the present petition stands dismissed.
