JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The victim is said to have been kidnapped by the petitioner and other co-accused in the morning on 25.11.2015 and the informant as well as his wife claimed themselves to be eye witnesses of the alleged occurrence but, even then, the first information report was lodged on 28.01.2016 after inordinate delay. Moreover, the victim has already returned to her home and her statement under section 164 of the Cr.P.C was recorded in which she stated that she was taken to Delhi where she was sexually assaulted by the co-accused Vijay Sharma. Learned counsel for the petitioner submits that one coaccused Arbind Kumar Sharma @ Arbind Sharma has already

Patna High Court Cr.Misc. No.13802 of 2016 (2) dt.04-04-2016 2/2 granted privilege of bail by a co-ordinate Bench of this Court. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IV, Siwan in connection with Raghunathpur P.S.Case No. 09 of 2016.
