JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-04-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner left the Pairvi of his case in the year 2004 as a result whereof his bail bond was cancelled and, subsequently, in the year 2011 he was declared absconder. The petitioner was arrested by the police on the strength of permanent warrant of arrest and produced before the trial court on 23.09.2015 and since then he is languishing in custody.
Submission on behalf of the petitioner is that charge has already been framed against the petitioner and, therefore, there is no need to keep the petitioner in jail custody as under trial prisoner but I am not at all convinced with the aforesaid submission and taking note of previous conduct of the petitioner,
Patna High Court Cr.Misc. No.16140 of 2016 (2) dt.21-04-2016 2/2 the prayer for bail of petitioner in connection with Ghoshi P.S. case No. 249 of 2002 (S. Tr. No. 69/16 10/16) stands rejected. However, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible, preferably, within four months by taking the trial of the petitioner on day to day basis. It is made clear that if the trial of the petitioner is not concluded within the above stated period of four months, the petitioner may renew his prayer for bail before the trial court itself.
