The petitioner seeks bail in Uchkagaon P.S. Case No. 118/2017, instituted for offence under Section(s) 147, 148, 149 and 302 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that informant is not eye-witness to the occurrence. It is alleged in the written report that informant got information that her father has sustained injury. Thereafter informant went to her father who disclosed that he has been assaulted by Ajay Sah with Farsa on his head. He further disclosed that one Dhananjay Sah had assaulted him with handle of hand pump causing fracture injury in his leg. Learned counsel for the petitioner has submitted that
Patna High Court Cr.Misc. No.4533 of 2019(2) dt.08-02-2019 2/2 name of this petitioner has been taken by the father of informant levelling general and omnibus allegation against him. Co-accused Ajay Sah has already been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 17020/2018 dated 04.05.2018.
Petitioner is in custody since 27.11.2018.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Ixth A.C.J.M., Gopalganj in connection with Uchkagaon P.S. Case No. 118/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
