====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 16-05-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Sahodara P.S. Case No. 65 of 2021 registered under Section 414 of the Indian Penal Code read with Section 8, 20 (b)(ii)(b), 8, 20 (b)(ii) (c) of the N.D.P.S. Act.

The learned counsel for the petitioner submits that the petitioner is in custody since 04.08.2021, charge-sheet has been submitted in the case, has antecedent of one case under the Excise Act and allegation is of recovery of 4.5 Kg. of Ganja from the seat of the motorcycle on which the wife of the petitioner was also present. The learned counsel submits that admittedly the alleged recovered Ganja is little more than small quantity but less than commercial quantity.

The learned A.P.P. for the State opposes the prayer for

Patna High Court CR. MISC. No.4764 of 2022(2) dt.16-05-2022 2/2 bail of the petitioner.

At this stage, the learned counsel for the petitioner seeks permission to withdraw the present bail application. Permission is accorded with liberty to the petitioner to renew his prayer after framing of charge.

Accordingly, the present bail application is dismissed as withdrawn.
