Petitioner seeks bail in a case registered for the offences punishable under sections 341, 302, 201/34 of the Indian Penal Code.
Petitioner is not named in the F.I.R. Chowkidar of the village lodged a case against unknown after recovery of the dead body which was later on identified as that of Ishwari Singh. During course of investigation, one Mahabir Yadav in his statement under section 164 Cr. P.C. disclosed that Dharmendra Yadav, Hare Krishna Yadav, Ramesh Yadav (petitioner) and Ishwari Singh had come to sell the trolley. Thereafter dead body of Ishwari Singh was recovered.
It is submitted that Dharmendra Yadav and Hare
Patna High Court Cr.Misc. No.22547 of 2015 (3) dt.15-09-2015 Krishna Yadav have already been enlarged on bail vide order passed in Criminal Misc. No. 49269 of 2014. Case of the petitioner stands on the same footing.
Learned Additional Public Prosecutor opposed the prayer for bail.
Except the confession and the statement of one Mahabir Yadav there appears to be no other material against the petitioner. Similarly situated co-accused Dharmendra Yadav and Hare Krishna Yadav have already been enlarged on bail. Considering the facts aforesaid, petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Arrah in connection with Tiyar P.S. Case No. 36 of 2014.
