JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Near about 134 liters country made liquor is said to have been recovered from the house of the petitioner for which petitioner is in jail custody since 11.09.2015. Earlier, the prayer for bail of the petitioner was rejected by this court vide order dated 15.12.2015 passed in Cr. Misc. No. 56555 of 2015. Submission on behalf of the petitioner is that the petitioner has sufficiently been punished by remaining in jail custody and prior to institution of the present case, only one case under the Excise Act had been registered against the petitioner and so far as other cases are concerned, the same had been registered for the offences of Indian Penal Code.
Patna High Court Cr.Misc. No.14173 of 2016 (2) dt.18-05-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate,1st class, Begusarai in connection with Naokothi P.S.Case No. 117 of 2015.
