JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-02-2020 Earlier by order dated 6.3.2019 passed in Cr.Misc.No. 13088 of 2019 notice was directed to be issued to opposite party No.2 and interim protection was granted to the petitioner and it appears that due to non-filing of requisites earlier application was dismissed for non-compliance of the order. Now fresh application has been filed for grant of anticipatory bail on the ground that he is ready to keep his wife.

Considering the above, I am not inclined to grant the privilege of anticipatory bail to the petitioner. However, if petitioner is really interested he could have approached opposite party No.2-wife and persuaded her to reside with him but there is no such averment in the petition. However, petitioner is at

Patna High Court CR. MISC. No.2991 of 2020(2) dt.26-02-2020 2/2 liberty to persuade her to reside with him and if she agrees and both of them appear and file an affidavit to that effect, the learned court below shall consider the above, while considering prayer for bail of the petitioner.

Accordingly, this application is dismissed with the above observation.
