The petitioner seeks bail in a case registered for the offence under Section 302 / 34 of the Indian Penal Code. There is general and omnibus allegation against all the accused persons including this petitioner of commission of assault by bricks and stones. From perusal of F.I.R., it is apparent that informant is not eye-witness to the alleged occurrence. Petitioner claims clean antecedent and he is in custody since 01.11.2021.

However, learned A.P.P. for the State and learned counsel for the informant vehemently opposed the bail petition and submitted that there is specific allegation against this petitioner and other co-accused of committing murder of father of informant.
