The petitioners are apprehending their arrest in connection with Laxmipur P.S.Case No.397 of 2018 , registered for offences punishable under Sections 147, 341, 323, 307/34 of the Indian Penal Code.

Allegation against the petitioners and several other accused persons is that they caught hold of the brother of the informant and the petitioner no.1 assaulted by rod on his head and later on all the petitioners assaulted him. Submission of the learned counsel for the petitioners is that as a matter of fact the brother of the informant has received injuries in an accident and there is case and counter case. Heard learned A.P.P. as well as learned counsel for the

Patna High Court CR. MISC. No.2654 of 2019(4) dt.17-04-2019 2/2 informant. They have opposed the prayer for bail on the ground that one of the injuries on the brother of the informant on head was found to be grievous in nature. .

Having heard both sides and in view of the facts and circumstances, as stated above, so far petitioner no.1 Dilip Singh is concerned, I am not inclined to grant privilege of bail, however, so far petitioner nos. 2 Shantosh Singh, 3 Tengu Singh @ Narmendra Kumar, 4. Pintu Singh, 5. Anuj Singh and 6. Dharam Singh are concerned, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Jamui in connection with Laxmipur P.S.Case no.397 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid observation, this application is allowed.
