====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 17-01-2019 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in Sessions Trial No. 742A of 2010 arising out of Khaira P.S. Case No. 05 of 2004 instituted for the offence under Section(s) 323, 341, 147 and 307/34 of the Indian Penal Code.
Counsel for the petitioner submits that genesis of the occurrence is land dispute.
In the written report the allegation against the petitioner is that he assaulted the informant with Tangi on his head causing injury to him.
The injury report of the informant has been enclosed as Annexure-2 wherein the Doctor has found two injuries on his scalp. One lacerated wound on right side of forehead
Patna High Court Cr.Misc. No.2279 of 2019(2) dt.17-01-2019 2/2 measuring 1 1/2" x 1/2" x scalp deep and another on left temporal region of scalp measuring 2 1/2" x 1/2" x scalp deep caused by sharp cutting instrument and hard blunt substance and opinion was kept reserved.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned F.T.C. Jamui, in connection with Sessions Trial No. 742A of 2010 arising out of Khaira P.S. Case No. 05 of 2004, subject to the condition that both the bailors will be the close relatives of the petitioner.
