Earlier, the bail petition of petitioner was rejected, vide order dated 16.04.2021 passed in Cr.Misc. No. 6531 of 2021 (Annexure-1).

On last occasion, vide order dated 09.03.2022, a report was called for from the court below regarding stage of the trial, which has been received and from perusal of the same, it appears that after framing of the charge, the case is running at the stage of prosecution evidence and for production of prosecution witnesses, bailable warrant has been issued. It is submitted on behalf of the petitioner that petitioner is in custody since 01.08.2020 and there is no adequate progress in the trial.

Patna High Court CR. MISC. No.4932 of 2022(3) dt.20-04-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - II, Uda Kishunganj, District - Madhepura in connection with Udakishunganj Gwalpara P.S. Case No. 99 of 2020.
