JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-03-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 04.10.2018 in connection with Khaira P.S.Case No. 387 of 2018 registered for the offences punishable under Sections 395 and 412 of the Indian Penal Code.
According to the prosecution case itself, just after the alleged occurrence two persons were caught and looted articles were recovered from their possession but it is surprising enough that the F.I.R does not contain the name of the aforesaid apprehended persons rather the F.I.R was registered against the unknown persons. However, it is submitted on behalf of the petitioner that as a matter of fact, petitioner and one Md. Anwar
Patna High Court CR. MISC. No.4006 of 2019(3) dt.29-03-2019 2/2 were caught by the police and implicated them in the present case whereas the real culprits, who were caught just after the alleged occurrence were left by the police party. Petitioner does not have any criminal antecedent and admittedly co-accused Md. Anwar Sheikh @ Chhotu has already been granted privilege of bail by a co-ordinate bench of this court vide order dated 24.01.2019 passed in Cr. Misc. No. 3188 of 2019.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jamui in connection with Khaira P.S.Case No. 387 of 2018.
