JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-04-2023 The present writ petition has been filed seeking the following relief:- "(1) For the writ in the nature of mandamus commanding the petitioner has pray from Hon'ble Court to direction of concern authority to remove of Encroached land from Respondent no. 6 in respect of Khata no. 1345, khesra no.

3383 Rakba 6 decimals, that the land was situated at Mauza Mokama.

(ii) That the aforesaid land was earlier settled by the Circle officer to name of Sabo Devi and it has issued a land

Patna High Court CWJC No.7961 of 2017(2) dt.17-04-2023 2/2 possession certificate in the name of petitioner since 20.1.2014 through letter no. 448 thereafter settled of land to name of petitioner. She has created Jamabandi No. 63/A upon name and has also paid malguzari to the Government.

(iii) That in the mean time the Respondent no. 6 has illegal Encroached the aforesaid land and disposed by the petitioner."

At the outset, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law. Liberty, so sought, is granted.

The writ petition stands dismissed as not pressed.
