The petitioner is accused in connection with Siwan Muffasil (Dhanauti O.P.) P.S.Case No. 14 of 2016 registered under Sections 341, 323, 354 ( B), 387, 447, 504, 506/34 of the I.P.C.
The accusation against the petitioner is of abusing and assaulting to the informant and also unfolding her sari and her mother-in-law's sari with an intention to outrage their modesty. From perusal of the F.I.R. it appears that the occurrence occurred between the parties due to dispute of fitting the hand pump by the informant.
Patna High Court Cr.Misc. No.13632 of 2016 (2) dt.11-04-2016 2/2 Learned counsel for the petitioner submits that the petitioner and the informant are the Pattidars and due to land dispute occurrence took place as the petitioner having no criminal antecedent, is in custody since 14.02.2016.
Under the facts and circumstances of the case, the petitioner Subash Sah, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) with two sureties of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Siwan Mufassiil (Dhanauti O.P.) P.S. Case No. 14 of 2016 out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Sudha/- U T
