Petitioners apprehend their arrest in a case registered for the offence punishable under Section 341, 323, 504, 506, 353/34 of the Indian Penal Code.
As per the prosecution case, all the accused persons including these petitioners attacked upon the police team, pelted stones and put hindrance in discharge of their official duty. Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in
Patna High Court CR. MISC. No.4458 of 2022(2) dt.26-07-2022 2/2 the case. There is general and omnibus allegation against these petitioners and no specific overt act has been alleged against them. As a matter of fact no one has sustained any injury. It is further submitted that except Section 353 of the IPC all other sections are bailable and Section 353 of the IPC has been added with a view to make the case non bailable. Petitioners have got clean antecedent.
Learned counsel appearing for the State opposes the prayer for anticipatory bail.
Considering the facts of the case and clean antecedent of the petitioners, let the petitioners, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Siwan in connection with Nautan PS case No. 199/ 2021, subject to conditions laid down u/s 438(2) of the Cr. P. C. (Prabhat Kumar Singh, J) BKS/- U T
