2. On query of the Court, from the learned counsel for the petitioner with regard to the stage of the case, the learned counsel for the petitioner submits that despite his best endeavour he could seek instruction from the petitioner.

3. The learned Mr. Chandra Bhushan Prasad submits that the present quashing application has been filed seeking quashing of the order by which the discharge application of the petitioner has been rejected, it is next submitted that in the event if the Court interferes with the order and the charges have been framed and the trial has commenced in that view of the matter the entire effort of the Court would go futile.

4. Considering the submission made by the learned

Patna High Court CR. MISC. No.18183 of 2016(2) dt.11-09-2023 2/2 APP the Court is not inclined to entertain the quashing application, accordingly rejected.
