JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-379/411 of the Indian Penal Code .

No doubt, the petitioner along with one accused is said to have been caught on the spot and stolen mobile has been recovered from conscious possession of co-accused but submission on behalf of petitioner is that a hot exchange of words had taken place between the informant and co-accused for taking tickets as a result whereof, the informant lodged this false case and moreover, the stolen mobile has not been recovered from conscious possession of the petitioner and the petitioner does not have any criminal antecedent.

Considering the above-said facts and circumstances of

Patna High Court Cr.Misc. No.14813 of 2016 (2) dt.11-04-2016 2/2 the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Patna Junction P.S.
