JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 22-06-2021 Learned counsel for the petitioner undertakes to remove all the defects as pointed out by office within four weeks after start of normal functioning of the Court. Heard learned counsel for the petitioner and learned A.P.P. for the State.

Petitioner in the present case is seeking regular bail in connection with Muffasil P.S. Case No.226/2020 registered for the offences punishable under Sections 25(1-AA), 25(1-B)a, 26(1)(2)/35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Learned counsel submits that nothing incriminating has been recovered from the conscious possession of the petitioner

Learned APP for the State is present and has opposed the prayer for regular bail of the petitioner. Having regard to the facts and circumstances of the case and the materials showing that the petitioner has been arrested with the co-accused in course of search of the house of the co-accused and from there police has found five automatic pistol which was loaded with one magazine each and fifty live cartridges and then in another bag five country made pistol, considering the seriousness of the allegations, this Court is not inclined to grant bail to the petitioner. The prayer is, thus, refused.

Let the trial be expedited. It is expected that the learned trial court shall proceed with the case as early as possible.
