2. The present application has been preferred for the following relief(s):

for direction upon the respondents not to interfere in the peaceful physical possession over the land which was been settled 1976-77 to the petitioner in the year in view of the fact that the respondents are forcibly trying disposses this petitioner family to and member in the garb of rehabilitation without adopting due process

A counter affidavit has come on behalf of the respondent nos. 4 to 8 after service to the learned counsel for the petitioner on 13.09.2017 and as per paragraph 12, recommendation has been made before the Additional Collector, Aurangabad for cancellation which led to Case No. 89 of 201617. Neither the petitioner nor the State has any instruction on the present status of case no. 89 of 2016-17.

4. The writ petition is accordingly disposed of with a direction that if the same has not been disposed of, the petitioner shall appear and pursue the case if the aforesaid Cancellation Case No. 89 of 2016-17 already stands disposed of, the petitioner has to take remedy/matter to an appropriate authority/Court if the order has been passed against him.

5. The writ petition stands disposed of with aforesaid observation.
