JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-04-2023 The present writ petition has been filed seeking the following reliefs :- " (i) For issuance of a writ preferably in the nature of Mandamus commanding and directing to the Respondents concerned to remove the encroachment over the land of the petitioner, which has been encroached by the private respondent No.8 and 9, however, a Purcha was issued on 30.1.1996 in the favour of the father of the petitioner namely
Patna High Court CWJC No.6814 of 2017(2) dt.17-04-2023 2/2 Punit Pandit, under the Bihar Privileged persons Home-stead Tenancy Act, 1947 (there-in-after referred to B P P HT Act) for the land measuring area 16 Dhur, MauzaBalliya, Thana No.-627, Tauzi No.625, Khata No.671, Khera No.2231, under Balliya Subdivision at District-Begusarai." After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies, as are otherwise available under the law. Liberty so sought, is granted.
