The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 149, 323, 307, 504, 506/34 of the Indian Penal Code. As per prosecution case, the informant alleged that the accused persons including the petitioner brought the informant's son for intoxication then the informant prohibited them due to which some scuffle took place between them. The accused persons started assaulting on the head of informant by means of iron rod due to which he sustained injury.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. From perusal of FIR, it

No.4782 of 2023(2) dt.06-04-2023 2/2 appears that the alleged occurrence took place on 17.8.2020 but the present case has been filed on 1.9.2020 after 14 days delay without giving reasonable explanation. It is further submitted that there is case and counter case, both parties sustained injuries as alleged in separate occurrence. A statement has been made in para-3 of the petition that the petitioner has got no criminal antecedent. It is further submitted that the petitioner is languishing in judicial custody since 1.8.2022. Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Athmalgola P.S. Case No. 211 of 2020 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Barh/concerned Court.
