ANJANA PRAKASH ORAL ORDER 05-02-2015 The case has come up under the heading 'To Be Mentioned' at the instance of the Petitioner. It has been submitted that since the brother of the Petitioner does have any landed property, he has not been permitted by the Court below to become a bailor of the Petitioner. I am surprised at the attitude of the Magistrate. He is directed to look into a decision reported in 2014 (1) PLJR 670 wherein this Court has laid down that all the Magistrates are to see with regard to the credibility of bailor and nothing more. Hence, the Magistrate concerned is directed to allow him as a bailor on being satisfied that he is a credible person. Let this order be communicated to the ADJ VII-cumSpl.
