The petitioner seeks bail in connection with G.O. Case No. 151 of 2021 instituted for the offences under Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 08.09.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the allegation is of recovery of 90 litres of liquor from a motorcycle near Nepali border by S.S.B. personnel.

Learned counsel for the petitioner submits that the petitioner was a mere passerby, the real culprits on seeing the

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-IIcum-Special Judge (Excise), Sitamarhi in connection with G.O. Case No. 151 of 2021.
