JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 8.4.2015 in a case registered for the offences punishable under Section379,411,120B and 413 of the Indian Penal Code. On theft of the motorcycle of the informant, FIR was lodged against eight named accused persons. The name of the petitioner sprang up on the statement of apprehended accused from the spot.
It is submitted by the learned counsel for the petitioner that the investigation has already concluded and there is no recovery from the petitioner. One of the apprehended accused namely Pradeep Kumar Yadav from whom motorcycle was recovered, has been granted bail vide Cr. Misc. No. 19338 of
Patna High Court Cr.Misc. No.23526 of 2015 (2) dt.13-07-2015 2/2 2013. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Saharsa in connection with Bihra P.S. Case No. 165 of 2012.
