Petitioner seeks bail in connection with Dihri (T) Police Station Case No.367 of 2010, registered for the offences punishable under Sections 147, 148, 326, 302, 452 of the Indian Penal Code and Section 27 of the Arms Act pending in the court of learned Sub-Divisional Judicial Magistrate, Dihri, Rohtas. Petitioner is one of the assailants. Two persons were killed by the petitioner and co-accused, Samarajya Kharwar, by causing injury with sharp cutting weapon in presence of the informant.

Submission is that petitioner is in custody since 29.09.2018. Investigation of the case is already complete.

Patna High Court CR. MISC. No.4100 of 2019(4) dt.13-05-2019 2/2 Petitioner has got no criminal antecedent. False allegation is there, due to trivial dispute arising out of marriage. Considering the nature of allegation, I am not inclined to enlarge the petitioner, above named, on bail for the present. Hence, prayer is refused.

The learned trial court is directed to expedite the trial.
