JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 02-05-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with K. Hat P.S. Case No. 1199 of 2022, registered for the offences punishable under Sections 8(c)/21(b) of the N.D.P.S. As per allegation, the police got a secret information that some miscreants engaged in illicit business of brown sugar have assembled in Kosi Colony. The police raided that place and arrested 7 accused persons from the place of occurrence, including the petitioner. From possession of co-accused Kunal Kumar Paswan, 7 gm of smack like substance was recovered. Some mobile sets were recovered from other co-accused persons.

The learned counsel for the petitioner has submitted that he is innocent and has falsely been implicated in this case

Patna High Court CR. MISC. No.4288 of 2023(2) dt.02-05-2023 2/2 merely on the basis of his previous antecedent. Nothing was recovered from possession of the petitioner. He is under custody since 11.11.2022.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Special Judge, N.D.P.S., Act, Purnea in connection with K. Hat P.S. Case No. 1199 of 2022 , subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) The petitioner shall cooperate in the disposal of trial and make himself available on each and every date of trial. In case of failure on two consecutive dates without any valid reason, the learned court below will be at liberty to cancel the bail bond of the petitioner.
