JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 01-10-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection S.T. No. 10 of 11/117 of 12 arising out of Saharsa Sadar P.S. Case No. 195 of 2010 registered under Sections 302, 307, 324 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. rather his name has come in the confessional statement of co-accused, Raman Singh, as detailed in paragraph 69 of the case diary, except that there is nothing against the petitioner. Later on, after one and half month of the occurrence, one witness in paragraph 77 of the case diary

Patna High Court Cr.Misc. No.23283 of 2015 (4) dt.01-10-2015 has stated that this petitioner was seen sitting on the alleged motorcycle. It is further stated that all the witnesses have been examined and the statement of the petitioner under Section 313 Cr.P.C. has also been recorded but till today the trial has not been concluded and this petitioner is in custody since 08.07.2011. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Ist Additional Sessions Judge, Saharsa, in connection with S.T. No. 10 of 11/117 of 12 arising out of Saharsa Sadar P.S. Case No. 195 of 2010. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
