JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 399, 402, 414 of the Indian Penal Code as well as Section 25(1-b)a/26/35 of the Arms Act.

Two cartridges, one coin and some cash are said to have been recovered form conscious possession of the petitioner when petitioner and others allegedly assembled to make preparation for committing dacoity.

Contention on behalf of the petitioner is that prior to institution of the present case, petitioner was not accused in any case, but when he was arrested in the present case, he was made accused in several cases. It is further submitted that moreover,

Patna High Court Cr.Misc. No.14740 of 2016 (2) dt.08-04-2016 2/2 more or less having similar allegation, co-accused Jeevan Sunar has already been granted privilege of bail by this Court. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Benipur, District- Darbhanga in connection with Bahera P.S.
