The petitioner is languishing in custody since 13.01.2014 in a case registered for the offences punishable under Section 386 of the Indian Penal Code.

Extortion demand was made from the informant twice, first from Mobile No. 8229865486 and thereafter from Mobile No. 8678887254. During investigation the mobile was found registered in the name of Arjun Kumar and Sanjida and they could not be traced, but the location of the mobile was near the house of the petitioner.

It is submitted by learned counsel for the petitioner that petitioner has been apprehended only on the basis

Patna High Court Cr.Misc. No.22797 of 2015 (2) dt.13-07-2015 2/2 of suspicion and the investigation has already concluded. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 293 of 2013. Since the petitioner has serious criminal antecedent, the learned court below will be at liberty to cancel the bail bonds of the petitioner in two eventualities i.e. if he defaults for two consecutive occasions or gets substantially involved in some serious nature of offence.
