The earlier bail application of the petitioner was rejected vide Cr.Misc.No.40424 of 2015 dated 01.12.2015 with an observation that the same is rejected at this stage. This is the second attempt for regular bail on behalf of the petitioner.

Vide order dated 06.04.2016, a report was called for regarding the stage of the case by the trial court and the same is kept at flag-'A'.

Out of nine chargesheet witnesses, only one witness is said to have been examined who is the informant herself. The deposition of the informant is Annexure-4 to the present application. From perusal of the same, it appears that the

Patna High Court Cr.Misc. No.14495 of 2016 (3) dt.11-05-2016 informant has not supported the prosecution nor has made any allegation against this petitioner. Petitioner is a lady who is aged about 70 years.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge, Araria in connection with Sessions Trial No.193 of 2015 arising out of Araria Mahila P.S.Case No.40 of 2013.
