JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 19-11-2024 Learned counsel for the petitioner submits that the petitioner had deposited Rs.52,250/- in the Ara Treasury vide Treasury Challan No.80 dated 30.06.2006 at the time of filing the case under Section 16(3) of Bihar Land Reforms (Fixation of Ceiling Area and Acquisition of Surplus Land) Act, 1961 vide Land Ceiling Case No.2/2006-07 which he lost and in this regard he has filed an application before the Deputy Collector Land Reforms, Piro Sub Division, District-Bhojpur Ara to return the deposited amount but neither the said amount has been returned nor any response has been given by the concerned Authority. Accordingly, he submits that this case may be

Patna High Court CWJC No.7177 of 2017(2) dt.19-11-2024 2/2 disposed of with liberty to petitioner to file fresh application/representation within four weeks to the concerned authority.

2. Learned counsel for the State has no objection to this prayer of the petitioner.

3. In view of the submission of learned counsel for the petitioner, this writ petition stands disposed of with liberty to the petitioner, as prayed for.

4. If the petitioner files the said representation within four weeks, the same shall be disposed of by the concerned authority expeditiously, preferably within three months thereafter.
