2. The petitioner seeks regular bail in connection with Warsaliganj P.S. Case No. 573 of 2023, lodged on 15.11.2023, under Sections 363/366A of the Indian Penal Code.

3. As per the prosecution, allegation of kidnapping is there in the FIR.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He submits that the victim has been recovered and she has eloped with the petitioner with her consent. On previous occasion case diary was called for. Counsel submits that antecedent of the petitioner is clean. He is in custody since 16.11.2023.

5. Learned counsel for the State opposes the prayer for bail.

6. Learned counsel for the informant appeared and submits that case diary as well as statement under Section 164 Cr.P.C. was called for.

7.Upon perusal of the statement it transpires that the ingredient of offence is present. As such, this Court is not inclined to grant bail to the petitioner for the present. Accordingly, the prayer for regular bail of the petitioner is hereby rejected.
